In a nutshell, evidence of peaceful coexistence between two trademarks in the marketplace alone is not enough to eliminate likelihood of confusion as a basis for rejection of a trademark application.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">The ACJT issued Prejudicial Interpretation 65-IP-2019 on November 19, 2019, as part of an Annulment Action filed before the Colombian Council of State by plaintiff Behr Process Corporation against the Superintendence of Industry and Commerce (where the Colombian Trademark Office lies), seeking to Annul the Resolutions which rejected the trademark \u201cBEHR PREMIUM PLUS CON ESTILO &amp; DESIGN\u201d in Class 2.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">En la mencionada Interpretaci\u00f3n Prejudicial, el TJCA indica primero que la coexistencia pac\u00edfica de signos se refiere al hecho que los signos en conflicto (signos id\u00e9nticos o similares que identifican productos o servicios id\u00e9nticos o similares) han estado presentes en el mercado durante un per\u00edodo prolongado de tiempo sin que surjan problemas de confusi\u00f3n, indicando que el t\u00e9rmino \u00ab<\/span><i><span style=\"font-weight: 400;\">peaceful<\/span><\/i><span style=\"font-weight: 400;\">\u00bb se refiere a que no hay conflicto legal pendiente ante ninguna jurisdicci\u00f3n en donde se advierta riesgo de confusi\u00f3n o asociaci\u00f3n entre las marcas en cuesti\u00f3n.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">El TJCA luego menciona que el an\u00e1lisis sobre el riesgo de confusi\u00f3n entre las marcas es prospectivo, ya que no pretende establecer si ha habido eventos reales de confusi\u00f3n, sino la posibilidad futura de riesgo de confusi\u00f3n o asociaci\u00f3n ante los consumidores. Sin embargo, la coexistencia pac\u00edfica de signos, aunque por s\u00ed sola no es concluyente con respecto a la falta de riesgo confusi\u00f3n o asociaci\u00f3n, puede tomarse como un indicio de la misma en un an\u00e1lisis retrospectivo. As\u00ed, cualquier persona que alegue la coexistencia pac\u00edfica de signos debe proporcionar evidencia adicional para respaldar la falta de riesgo de confusi\u00f3n o asociaci\u00f3n entre las marcas en cuesti\u00f3n, por ejemplo, \u00ab<i>statistical analysis of differentiation in the consuming public and people participating in the distribution channels, or evidence demonstrating that they have shared effective publicity settings (specialized magazines, musical or sports events, among others), without risk of confusion being present<\/i>\u00ab.<br \/><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">As such, any person alleging peaceful trademark coexistence must provide additional evidence to support the lack of likelihood of confusion or association between the marks in question, such as \u201cstatistical analysis of differentiation in the consuming public and people participating in the distribution channels, or evidence demonstrating that they have shared effective publicity settings (specialized magazines, musical or sports events, among others), without risk of confusion being present.\u201d<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The trademark coexistence must be peaceful, as defined above.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Coexistence must be in the same geographic or virtual market.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">La coexistencia debe tener lugar durante un per\u00edodo de tiempo razonable para tener incidencia efectiva en el consumidor, donde lo \u00ab<\/span><i><span style=\"font-weight: 400;\">reasonable<\/span><\/i><span style=\"font-weight: 400;\">\u00bb depender\u00e1 de la naturaleza de los productos o servicios (es decir, productos b\u00e1sicos versus de lujo o productos disponibles de forma permanente versus productos de temporada).<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Coexistence may not be present to perpetuate, facilitate or consolidate acts of unfair competition.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Evidence of coexistence must be accompanied by other evidence which generate total conviction over the lack of likelihood of confusion or association.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">As such, when arguing that there is no likelihood of confusion between marks because the marks in question have been peacefully coexisting in the market for a long period of time, be prepared to submit additional evidence that supports the consumer\u2019s perception that the marks are indeed different and point to different and unassociated business origins (basic elements or likelihood of confusion and association).<\/span><\/p>\n<div>&nbsp;<\/div>","protected":false},"excerpt":{"rendered":"<p>Fecha: 20 de marzo de 2020 Una vez m\u00e1s, el Tribunal de Justicia de la Comunidad Andina (TJCA) nos recuerda su posici\u00f3n con respecto a la coexistencia pac\u00edfica de signos en el mercado como prueba de la falta de riesgo de confusi\u00f3n y de asociaci\u00f3n entre ellos.
